No signed commission agreement? The principal has not paid the remuneration due.
The client was working as a cook in a well-known Warsaw restaurant. After he decided to change jobs, the boss of the company stated that he would somehow punish the employee and would not pay him for the last days of his work. Despite his requests, his salary was not paid, he was ignored and he was blocked. He decided to fight for justice, even though the amount was not large for him. He also did not have a written assignment contract with the Employer, so he was afraid that he would not be able to prove in any way the remuneration due to him in Court.
Should the commission agreement be in writing? No, as all restrictions as to the content of the contract are listed in the Civil Code Articles 734-751. There is no obligation to conclude a contract of mandate in writing.
After a properly drafted and filed claim for payment, the outstanding remuneration was awarded to the client, which was then enforced by a bailiff in enforcement proceedings.
