BAN ON DRIVING IN EU BASED ON A DECISION OF A POLISH COURT
The ban is still in force and is applied in practice!
Recently, we have been receiving questions from our clients as to whether, in a situation where a driving ban was imposed as a result of a court decision in the territory of the Republic of Poland, this ban is also valid in Germany or Latvia.
Pursuant to Article 11 of the European Union Directive 2006/126/EC on driving licences, each Member State shall refuse to recognise the validity of any driving licence that has been restricted, suspended or withdrawn in another Member State.
This directive is in force and is being applied in practice, as evidenced by the responses of the Ministry of Transport of Latvia and the Federal Ministry of Digital Information and Transport of Germany.
For example, if, as a result of a conviction in Poland for an offence under Article 178a of the Criminal Code, i.e. driving under the influence of alcohol, the convicted person is deprived of the right to drive for 3 years neither in Poland nor in any other EU country.
