I HAD A CASE IN COURT, I WAS CONVICTED - CAN I GET POLISH CITIZENSHIP?
The answer is - it depends. I was approached by a client with a fairly common issue - he was refused recognition as a Polish citizen due to a criminal case from 2016. The client actually admitted that there was a case where he was driving a car and was under the influence of a car. He was detained, questioned, then a court hearing took place and a sentence was passed. The criminal record showed that the client had no criminal record and yet the Governor considered that there was a prerequisite justifying to not recognize him as a Polish citizen.
From the analysis of the client's life and legal situation, I decided to undertake the task of drawing up an appeal against the decision of the Governor and to conduct the appeal proceedings.
The Minister of Internal Affairs and Administration re-examined the case file and, as a result of an appeal filed by the Law Firm of Advocate Andriy Dementiy, the contested decision was overturned and the Client was recognised as a Polish citizen.
In the present proceedings, the appeal was prepared taking into account the specific situation of the Client, and additional documents were obtained to enable the authority to analyse the Client's case in greater detail. Once again, I am convinced that it is very important to involve a professional attorney with the necessary knowledge and experience in criminal matters in administrative migration cases. Not every criminal case results in a clear refusal in the issuing of a temporary residence permit or recognition as a Polish citizen.
